Frequently asked questions
What questions should a customer ask to hire the right service professional?
1Thfirst question with all lawyers is costs. A Lawyer, Barrister or Law Firm must provide a potential client a costs disclosure form, a 1-page short version outlining the costs, disbursements and GST payable. These disclosures are required for job quotes starting at $750 up to $3000 (excludes GST). Cost Estimates over $3000 MUST provide a document called a Costs Agreement ( most lawyers will provide this even if fees are <$3000. If your lawyer hasn’t provided this agreement and/or you haven’t signed it to say you accept it and the lawyer nonetheless starts working on your matter, they aren’t entitled to be paid for this work until the Costs agreement is presented signed b the client as ac spring the terms and returned to the practitioner. 2. Always ask to know the hourly fee as well separate to the costs agreement and even if a fixed fee amount has been agreed to, if there is any work outside the scope of the tasks in th costs agreement (conveyancing to sell pro-try in a family law matter). They will usually charge at the hourly rate. You don’t want to be paying your family law solicitor $500 an hour to sell your house. When conveyances are only around $1000 total. 3. Ask the lawyer to explain exactly what the scope in the costs agreement covers in terms you understand. Your lawyer may have decided your case will like;y only go to the interim hearing stage so the lump sum fee cover all work up to the interim. Your case gets listed for trial and you will get a nasty surprise from your lawyer by a new more expensive agreement for trial prep and all work including trial… you will want to know when the first agreement runs out and the Trial agreement and costs begin. 4. Is the lawyer a current member of the law society with a practicing certificate and does the lawyer or law firm have active PII insurance Www.lawsociety.com.Au/Find-a-lawyer. To check
